Holding
The court granted anticipatory bail to the petitioner, holding that the allegations did not satisfy the criteria for pre‑arrest detention and that procedural lapses justified bail.
Summary
Mahesh Kumar, the owner of a vehicle, was implicated in an excise case (Nawada Excise P.S. Case No. 65 of 2026) for the alleged possession of 117 litres of foreign liquor, although the liquor was recovered from the vehicle and not from his conscious possession. He filed an anticipatory bail petition, arguing that he was falsely implicated solely because he owned the vehicle and that procedural requirements for recovery under Section 100 of the CrPC and Section 103 of the Bihar Narcotic Substances (BNSS) Act were not complied with. The State opposed the bail, invoking Section 76(2) of the Bihar Prohibition and Excise Act and noting a pending case against the petitioner. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar, the court granted anticipatory bail with a bond of Rs.10,000 and two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS Act. The bail order also imposed obligations to cooperate with the trial, appear in court, and not tamper with evidence or conceal criminal antecedents.
Issues considered
- What is the applicability of anticipatory bail under Section 438 of the CrPC in the context of alleged excise offences?
- Whether the petitioner can be held liable when the seized liquor was not in his conscious possession but recovered from his vehicle?
- Do the procedural safeguards under Section 100 of the CrPC and Section 103 of the BNSS Act preclude the filing of charges against the petitioner?
