Patna High Court

Anil KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, holding that the quantity was below commercial threshold and mandatory provisions were not complied with, so Section 37 embargo did not apply.

Summary

Anil Kumar was arrested on 11 February 2026 in connection with a case under the Narcotic Drugs and Psychotropic Substances (NDPS) Act for alleged possession of 4 kg of ganja. The petitioner claimed innocence, argued that the seized quantity was below the commercial threshold and that mandatory provisions of the NDPS Act were not complied with, thus precluding the application of Section 37’s embargo on bail. The State opposed bail, noting a pending case against the petitioner and asserting that he was already on bail in that matter. The High Court examined the facts, noted the non‑compliance and the sub‑commercial quantity, and held that the embargo did not apply. Consequently, the Court granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding trial cooperation, non‑tampering with evidence, and verification of criminal antecedents.

Issues considered

  • Whether bail can be granted under the NDPS Act when the seized narcotic quantity is less than commercial quantity.
  • Whether Section 37 of the NDPS Act imposes an embargo on bail in the present circumstances.
  • Whether the existence of another pending case affects the grant of bail.

                   for the State.

                                   2. Petitioner seeks bail, who is in custody since

                                  4. Learned counsel for the petitioner submits that the

petitioner is innocent and he has been falsely implicated in the

present case. He further submits that it appears from the F.I.R. as

well as seizure list that altogether 04 Kgs. Of Ganja like substance

was recovered from the bag of the petitioner. He further submits

Act and apart from the aforesaid the recovered contraband is less

than the commercial quantity, so there is no embargo under

Section 37 of the N.D.P.S. Act to enlarge the petitioner on bail.

The petitioner is in custody since 11.02.2026.

                       5. Learned APP for the State, on the other hand,

vehemently opposed the prayer for bail of the petitioner and

submits that the petitioner carries one more case other than the

present one but fairly submits on the basis of paragraph-3 of the

bail petition that the petitioner is on bail in the pending matter.

                       6. Considering the facts and circumstances of the case

and the fact that there is non compliance of mandatory provisions

of N.D.P.S. Act and the recovered contraband is less than the

commercial quantity, let the petitioner, above named, be released

on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten

Thousand) with two sureties of the like amount each to the
