Patna High Court

Rahul KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioners subject to bond and attendance conditions.

Summary

Petitioners Rahul Kumar and Vikash Kumar were charged under IPC sections 394 (dacoity) and 302 (murder) and Arms Act section 27. Their earlier bail application was rejected, but they argued that no material (motorcycle or number plate) was recovered from them, the only recovery being from a co-accused who had already been bailed. The State contended that the lack of recovery from the petitioners did not justify bail. The High Court, after hearing counsel, found the petitioners not directly linked to the seized items and allowed the bail application, directing a bond of Rs.10,000 with two sureties who must be close relatives, and imposing a condition of monthly police‑station attendance. The order thus released the petitioners on bail subject to these conditions.

Issues considered

  • Whether regular bail can be granted to accused of serious offences (IPC 394, 302 and Arms Act 27) when no material evidence has been recovered from them.
  • Whether the prior denial of bail can be revisited on the basis of lack of recovery and the bail of a co‑accused.
