Holding

The court held that bail could not be granted as the petitioner had participated in the killing of the deceased.

Summary

The petitioner, Sachin Kumar, applied for regular bail in a murder case (PS Case No. 548 of 2025) involving offences under several sections of the B.N.S. and Section 27 of the Arms Act. The prosecution alleged that the petitioner participated in the killing of the deceased over a monetary dispute, and his name appeared in the self‑inculpatory statement of a co‑accused. The petitioner had been in custody since 17 October 2025. The court examined the seriousness of the alleged participation and the evidentiary material linking the petitioner to the crime. Concluding that the petitioner had taken part in the homicide, the court declined to grant bail. Consequently, the bail application was dismissed.
