Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond of Rs.10,000 and two sureties, under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

Sudhir Yadav petitioned for bail after being implicated in a case registered under sections 147, 149, 341, 323, 324, 325, 307 and 504 of the Indian Penal Code for allegedly assaulting Muniya Devi with an iron rod, causing a simple injury. The petitioner asserted a clean antecedent and feared arrest. The State opposed the bail application. The court examined the nature of the alleged injury, the petitioner’s clean record and the surrounding circumstances. Considering these factors, the court ordered that the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The bail order was directed to be complied with by the Chief Judicial Magistrate, Jamui.
