Holding
The court denied bail, holding that the petitioner’s antecedents and the nature of the offences preclude the grant of regular bail.
Summary
The petitioner, Samsuddin Nadaf, was charged under Sections 395 and 397 of the Indian Penal Code and Section 27 of the Arms Act for an alleged assault and robbery involving golden ornaments and cash. He has been in custody since 14 August 2024 and has prior antecedents, with his name appearing in a co-accused's self‑incriminating statement. The petitioner applied for regular bail for the second time. The court examined the seriousness of the offences, the petitioner’s criminal history, and the evidence linking him to the crime. Considering these factors, the court was not inclined to grant bail and dismissed the bail application.
