Patna High Court

Boki Jat @ Jamamuddin @ ZamamuddinversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The court held that bail could not be granted as the case involved a commercial quantity of ganja confirmed by forensic report.

Summary

The petitioner, Boki Jat, was arrested in connection with a case under Sections 8 and 20(b)(ii)(c) of the NDPS Act after 25 kg of ganja was recovered from his house. He contended that no incriminating article was found in his possession, claimed false implication, and highlighted his lack of prior criminal record. The prosecution presented a forensic laboratory report confirming the seized substance as ganja and argued that the quantity constituted a commercial amount. The court considered the seriousness of the offence, the confirmed recovery of a commercial quantity, and the statutory provisions governing bail in NDPS cases. Consequently, the court declined to grant regular bail and rejected the petitioner's application.

Issues considered

  • Whether bail can be granted in a case under Sections 8 and 20(b)(ii)(c) of the NDPS Act involving a commercial quantity of ganja
  • Whether the recovery of a commercial quantity of narcotics from the accused's residence justifies denial of bail
