The petition is disposed, with the disputed arrear amount to be determined by the Family Court and the petitioner directed to pay the agreed installments by 7 November 2026, while the distress warrant remains stayed.
Summary
Shishir Kumar was ordered by the Patna High Court to pay monthly maintenance of Rs.14,000 to his wife Anupma Anand and to clear arrears, with an initial payment of Rs.3,00,000 and the balance in five equal installments. The petitioner paid only the initial amount and failed to pay the remaining arrears, prompting him to seek modification of the order, claiming the total arrear to be Rs.5,12,000 and offering a bank draft of Rs.2,56,000 with a proposal to pay the balance in three installments. The respondent contested the arrear amount, calculating it at Rs.6,75,000, creating a dispute of Rs.1,63,000. The court directed that the disputed arrear be adjudicated by the Principal Judge of the Family Court, Muzaffarpur, with payment of the agreed installments to be completed by 7 November 2026 and the distress warrant stayed until then. The petition was consequently disposed, with a copy of the order to be sent to the Family Court for further action.

4. Now, learned counsel for the petitioner is seeking
permission to pay the rest amount of Rs. 2,56,000/- in three
