Patna High Court

Neha KumariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner, subject to verification of a clean antecedent and compliance with stipulated conditions.

Summary

Neha Kumari was arrested on 9 January 2026 in connection with a flesh‑trade case (Saharsa Sadar P.S. Case No.28 of 2026) and charged under multiple provisions of the Bihar Narcotic Substances Act, 2023, the Immoral Traffic (Prevention) Act, 1956, the POCSO Act and the Juvenile Justice Act. She applied for bail, asserting a clean antecedent, and her counsel highlighted that co‑accused Roshani Khatoon and Maymun Khatoon had been granted bail in similar cases. The High Court considered the seriousness of the allegations, the duration of her custody, and her status as a woman, and noted the precedent of bail to co‑accused. The Court allowed the bail application, directing that she be released on a bond of Rs.10,000 with two sureties, subject to verification of her clean antecedent and an affidavit undertaking not to resume such activities. The order expressly stated that it did not address the merits of the underlying criminal case.

Issues considered

  • Whether bail should be granted to the accused in a flesh‑trade case involving offences under the B.N.S., ITPA, POCSO and JJ Acts.
  • Whether the petitioner’s claim of a clean antecedent and the precedent of bail to co‑accused justify granting bail despite the serious nature of the charges.
