Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to regular bail and is released on bond.

Summary

The petitioner, Md. Ashif Mustafa, was arrested in connection with a case involving the alleged firing that led to the death of an informant's husband. The prosecution alleged that the petitioner was present at the scene, while the specific act of firing was attributed to co‑accused Nilesh Kumar. The petitioner claimed a clean antecedent and had been in custody since 19‑08‑2025. The State opposed the bail, but the court considered the nature of the accusation, the petitioner’s clean record, and the length of custody. Consequently, the court granted regular bail on a bond of Rs.10,000 with two sureties, directing release upon satisfaction of the Chief Judicial Magistrate.

Issues considered

  • Whether the petitioner is entitled to regular bail for offences under Sections 307, 34, 302 IPC and Section 27 of the Arms Act
  • Whether the petitioner’s alleged presence without a specific overt act warrants denial of bail
