Holding
Anticipatory bail cannot be granted if the petitioner is evading the court process and Section 83 Cr.P.C. proceedings have been initiated.
Summary
The petitioner, Jito Mandal, filed a pre‑arrest (anticipatory) bail petition claiming he was likely to be arrested. The State argued that the petitioner was evading the court process and that Section 83 of the Criminal Procedure Code had been invoked to compel his appearance. Relying on the Supreme Court’s decision in Prem Shankar Prasad v. State of Bihar (2021), the court examined whether anticipatory bail could be granted under such circumstances. The court held that when a petitioner is deliberately avoiding the court and Section 83 proceedings are pending, anticipatory bail cannot be granted. Consequently, the petition was dismissed, and the petitioner was directed to appear before the trial court.
