Patna High Court

Abhay Ray @ Abhay KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted subject to a bond and specified conditions.

Summary

The petitioner, Abhay Ray, was arrested on 1 April 2026 in connection with a case involving the seizure of 243 litres of illicit foreign liquor under Sections 30(a), 38 and 41 of the Bihar Prohibition & Excise Amendment Act. He contended that he was falsely implicated, that the seizure was not from his conscious possession, and that the investigation violated Sections 103 and 105 of the BNSS, 2023. The State opposed bail, noting that the petitioner has six other criminal cases, five of which are already on bail and one pending. The High Court, considering the alleged procedural lapses and the petitioner’s claim of innocence, granted bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of criminal antecedents. The order directed that the bail bond not be delayed for verification purposes.

Issues considered

  • Whether bail should be granted in view of alleged non‑compliance with Sections 103 and 105 of the BNSS, 2023.
  • Whether the petitioner’s pending criminal cases and antecedents preclude bail.
  • Whether the fact that the seized liquor was not found in the petitioner’s possession justifies bail.

petitioner is on bail in five cases and one case is pending for

consideration before the competent court of law.

                       6. Considering the facts and circumstances of the case

and the fact that there is non-compliance of Sections 103 and
