Patna High Court

Satyam KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on a bond of Rs. 10,000 with conditions, as the Court found no substantive evidence of his involvement and noted procedural non‑compliance.

Summary

The petitioner, Satyam Kumar, was arrested on 19 February 2026 in connection with the seizure of 546.75 litres of foreign liquor, alleged to be offences under Sections 30(a) and 32(ii) of the Bihar Prohibition & Excise Act. He pleaded that he has a clean antecedent, is not the owner of the vehicle from which the liquor was recovered, and was implicated merely on suspicion; he also asserted mental illness and highlighted non‑compliance of Sections 103 and 105 of the Bihar Narcotic Substances (Suppression) Act, 2023. The State opposed bail, but the Court, noting the petitioner’s clean record and the procedural lapses, granted bail on a bond of Rs. 10,000 with two sureties and imposed conditions regarding cooperation, non‑tampering with evidence, and verification of antecedents. The bail order was directed to be implemented by the Exclusive Special Excise Judge‑I, Bhagalpur. The decision reflects the Court’s balancing of the presumption of innocence against the seriousness of the alleged offences.

Issues considered

  • Whether bail should be granted to the petitioner despite the alleged offences under the Bihar Prohibition & Excise Act
  • Whether the non‑compliance of Sections 103 and 105 of the BNSS, 2023, warrants bail
  • Whether the petitioner’s mental illness and lack of ownership of the vehicle affect the bail decision
