The court granted bail to the petitioner on a Rs 10,000 bond with two sureties, subject to specific conditions.
Summary
The petitioner, Sintu Kumar, was arrested on 9 February 2026 in connection with a case alleging that he and others colluded to kill an informant by ramming his vehicle and assaulting him. The petitioner contended that the incident was a road accident, not a pre‑meditated attack, and that the FIR was fabricated. He also pointed out that co‑accused persons had already been granted bail in similar circumstances. The prosecution opposed bail, citing grievous injuries to the informant and the petitioner’s two prior criminal antecedents. The court, noting the precedent of bail to co‑accused and the lack of compelling evidence of intent, ordered bail on a Rs 10,000 bond with two sureties and imposed conditions regarding trial cooperation, evidence tampering, and verification of antecedents. The bail order was issued subject to the satisfaction of the Chief Judicial Magistrate, Begusarai.
Issues considered
- What is the appropriateness of granting bail to the petitioner given the nature of the alleged offences and his criminal antecedents?
- Does the alleged fabrication of the FIR and the claim of a road accident affect the bail decision?
- Should the bail be conditioned on cooperation, non‑tampering with evidence, and verification of antecedents?
