Patna High Court

Ashish Kumar @ Vijendra Kumar @ Vijayendra KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond and specified conditions.

Summary

The petitioner, Ashish Kumar, was arrested on 3 December 2025 in connection with a case involving the recovery of a loaded pistol, knives, mobile phones and 1.5 kg of ganja. He is charged under Sections 310(4), 310(5), 111 of the Bharatiya Nyay Sanhita, 2023; Sections 25(1‑B)(a), 26, 35 of the Arms Act; and Sections 8(c), 220(B)IIB of the NDPS Act, 1985. The petitioner contended that he was falsely implicated, relying solely on confessional statements of co‑accused, and that no other material linked him to the offence. The prosecution opposed bail, citing four prior criminal antecedents, though the petitioner had been acquitted in three cases with one pending. The High Court, after considering the circumstances, granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding trial attendance, non‑tampering with evidence, and verification of antecedents.

Issues considered

  • Whether bail should be granted to the petitioner despite the seriousness of the offences and the presence of prior criminal antecedents.
  • Whether the reliance on confessional statements of co‑accused, without other material evidence, justifies continued detention.
  • Whether the pending criminal antecedent case affects the grant of bail.

petitioner is innocent and he has falsely been implicated in the

present case. The name of the petitioner has been transpired on

the basis of confessional statement of apprehended co-accused

persons. From bare perusal of the seizure list it appears that

alleged recovery has been made from the possession of co-

accused persons, namely, Prince Kumar Pandey, Rohit Kumar,

Pawan Kumar @ Jhantu and and except the disclosure made by

apprehended co-accused persons, no other cogent material has

come during investigation which suggest the involvement of the

petitioner in the present occurrence. He further submits that the

petitioner is in custody since 03.12.2025.

5 The learned Additional Public Prosecutor has

vehemently opposed the prayer for bail of the petitioner on the

ground that petitioner carries four criminal antecedents but

fairly submits on the basis of paragraph-3 of the bail application

that the petitioner has been acquitted in three cases and one case

is pending for consideration before competent Court of law.

                       6. Considering the aforesaid facts and circumstances ,

let the petitioner, above named, be released on bail on furnishing

bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of

the like amount each to the satisfaction of the learned District

ii. If the petitioner tampers with the evidence or the

                       move for cancellation of bail.

iii. And further condition that the court below shall
