Patna High Court

Jitendra VernawalversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond of Rs.10,000, two sureties, and specified conditions.

Summary

The petitioner, Jitendra Vernawal, was arrested on 21 March 2026 in connection with a case involving the alleged illegal possession of 200 litres of spirit, alleged under Sections 30(a) and 32(3) of the Bihar Prohibition & Excise Act. The petitioner claimed he had no conscious possession of the seized spirit, that the vehicle from which it was recovered was not his, and that he had a clean criminal record. The State opposed bail, arguing the seriousness of the offences. The court examined the facts, noted the absence of possession by the petitioner and his clean antecedent, and ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions regarding cooperation, appearance, and non‑tampering with evidence. The bail order also directed verification of the petitioner’s antecedents without delaying the release.

Issues considered

  • Whether bail should be granted to the petitioner under Sections 30(a) and 32(3) of the Bihar Prohibition & Excise Act given the circumstances of the case.
  • Whether the lack of conscious possession of the illegal spirit and the petitioner’s clean antecedent justify granting bail.
  • What conditions, if any, are appropriate to impose on bail in such offences.
