Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on a bond of Rs.10,000 with conditions.

Summary

The petitioner, Nitish Kumar, was arrested on 18 April 2026 in connection with the seizure of 70.200 litres of foreign liquor under Section 30(a) of the Bihar Prohibition & Excise Act. He pleaded that he has a clean antecedent and was falsely implicated, and that the seizure list witnesses were police personnel, indicating non‑compliance with Sections 103 and 105 of the BNSS, 2023. The State opposed bail, but the court noted the petitioner’s clean record and procedural lapses. Accordingly, the court granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding cooperation, presence in court, and non‑tampering with evidence. The bail bond is to be accepted without delay pending verification of the petitioner’s antecedents.

Issues considered

  • Whether bail should be granted to the petitioner despite the alleged offence under the Bihar Prohibition & Excise Act.
  • Whether non‑compliance with Sections 103 and 105 of the BNSS, 2023 warrants bail.
  • Whether the petitioner’s clean antecedent and claim of false implication affect the bail decision.
