Patna High Court

SahilversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond and specified conditions.

Summary

The petitioner, Sahil, was arrested on 11 April 2026 in connection with an excise case involving the seizure of 216 litres of illicit liquor, alleged to be a violation of Sections 30(a), 32(1), 32(3) and 41(1)(2) of the Bihar Prohibition & Excise Amendment Act, 2022. He contended that he has a clean criminal record, was not the owner of the vehicle from which the liquor was seized, and that the seizure was conducted by Bihar Home Guard personnel in violation of Sections 103 and 105 of the Bihar National Security and Surveillance (BNSS) Act, 2023. The State opposed his bail application. The Court, after considering the petitioner’s clean antecedent and the alleged procedural lapses, granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding cooperation with the trial, non‑tampering with evidence or witnesses, and verification of his criminal antecedents. The bail bond is to be submitted to the Exclusive Special Judge (Excise)‑II, Kaimur, and may be cancelled if conditions are breached.

Issues considered

  • Whether bail should be granted to the petitioner despite the alleged violations of the Bihar Prohibition & Excise Amendment Act, 2022.
  • Whether the alleged non‑compliance with Sections 103 and 105 of the BNSS, 2023, and the petitioner’s lack of ownership of the seized vehicle justify bail.
  • Whether the petitioner’s clean criminal antecedent warrants release on bail.
