Patna High Court

Ravi Kumar ChaudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to bond and conditions.

Summary

Ravi Kumar Chaudhary was arrested on 2 March 2026 for alleged possession of 13.5 litres of foreign liquor seized from a tempo, an offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act. The petitioner filed a bail application, contending that the seizure list was prepared solely by police officers, violating mandatory provisions of Sections 103 and 105 of the BNSS, 2023. The State opposed bail, highlighting five prior criminal cases, though the petitioner was on bail in those matters. The Court examined the facts, the procedural claim, and the petitioner’s antecedents, and decided to grant bail on a bond of Rs.10,000 with two sureties and several conditions. The order also directed the lower court to verify the petitioner’s criminal antecedent and to cancel bail if any concealment or tampering occurs.

Issues considered

  • Whether the procedural lapse alleged under Sections 103 and 105 of BNSS, 2023 warrants denial of bail.
  • Whether the petitioner’s prior criminal antecedents justify refusal of bail.
