Bail was granted to the petitioner with a bond of Rs.10,000 and specified conditions.
Summary
Arvind Kumar was arrested on 11 April 2026 in connection with the seizure of 34.560 litres of illegal liquor from a motorcycle. He contended that the liquor was recovered from the vehicle, not from his conscious possession, and that he was not the owner of the motorcycle, arguing that his inclusion as an accused was merely on suspicion. The prosecution opposed bail, noting three prior cases against him, though he was already out on bail in those matters. The court examined the lack of direct possession and the petitioner’s claim of innocence, while also considering his criminal antecedent. It granted bail on a Rs.10,000 bond with two sureties, imposing conditions of cooperation, appearance, non‑tampering with evidence, and verification of his antecedents. The bail order was issued subject to cancellation if conditions were breached.
Issues considered
- Whether bail should be granted to the accused under the Bihar Prohibition and Excise Amendment Act despite the alleged recovery of illegal liquor from a vehicle associated with him.
- Whether the petitioner’s prior criminal antecedents justify denial of bail.
