The court granted regular bail to the petitioner with conditions.
Summary
Raju Paswan was arrested in connection with alleged firing at an informant's house, charged under several IPC sections (147, 148, 149, 387, 307, 504, 506) and Section 27 of the Arms Act. The petitioner claimed innocence, stating that his name appeared only in the informant's statement and that no one was injured. The State opposed bail, highlighting the seriousness of the offences and the petitioner's seven prior criminal cases. After hearing both sides, the court considered the lack of injuries, the petitioner’s cooperation, and the conditions of bail. The court granted regular bail on a bond of Rs.10,000 with two sureties, imposing conditions of trial cooperation and a close relative as a bailor.
Issues considered
- Whether regular bail should be granted to the petitioner despite serious charges and prior criminal antecedents
