Bail was granted to the petitioner.

Summary

The petitioner, a driver of an oil tanker, was charged under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act after 1,123.200 litres of illicit liquor were seized from the tanker. He contended that he had no knowledge of the liquor, that the seizure was not made in compliance with Section 105 of the BNSS, and that he had no prior criminal record. The State opposed bail, arguing the seriousness of the offence. The Court, after hearing both sides, found the petitioner’s claim of ignorance plausible and noted the procedural lapse in the seizure. Consequently, the Court granted bail on a bond of Rs. 10,000 with two sureties, directing compliance with the Special Excise Judge’s conditions.

Issues considered

  • Whether bail should be granted to a driver accused under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act for alleged possession of illicit liquor.
  • Whether the alleged non‑compliance with Section 105 of the BNSS in making the seizure affects the bail decision.
