The court granted bail to the petitioners.

Summary

The petitioners, Chandan Kumar Ravi and Chandni Kumari, were arrested in connection with a case involving the seizure of 263.250 litres of illicit foreign liquor under Section 30(a) of the Bihar Prohibition and Excise Act. They contended that they were merely a driver and a passenger, respectively, and that no liquor was recovered from their possession. They further argued that the police failed to comply with Section 105 of the BNSS during the seizure and highlighted their clean criminal record and continued judicial custody since 26‑03‑2026. The State opposed the bail application. After hearing both sides, the Patna High Court found merit in the petitioners' arguments and ordered that they be released on bail upon furnishing a bond of Rs.10,000 each with two sureties, subject to the satisfaction of the Exclusive Special Excise Court‑I, Nawada.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act in view of the facts of the case.
  • Whether the alleged non‑compliance with Section 105 of the BNSS during the seizure affects the bail consideration.
