Patna High Court

Kanhaiya KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, directing his release upon furnishing bail bonds and sureties.

Summary

The petitioner, Kanhaiya Kumar, sought anticipatory bail fearing arrest in a case registered under Section 25(9) of the Arms Act. The FIR did not initially name him, but later investigation indicated his presence at the incident. A co-accused, Diwakar Thakur, had already been granted anticipatory bail, strengthening the petitioner's claim. The Court examined the lack of direct allegations against the petitioner and the precedent of bail to the co-accused. Accordingly, the Court allowed the anticipatory bail application, directing release upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under the CrPC. The order was pronounced by Justice Sandeep Kumar.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 25(9) of the Arms Act despite his later identification in the investigation
  • Whether the grant of anticipatory bail to a co-accused influences the petitioner's entitlement to bail
