Patna High Court

Arun Kumar SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to regular bail.

Summary

Arun Kumar Singh applied for regular bail in a case (P.S. No. 387 of 2022) involving offences under IPC sections 341, 323, 324, 307, 379/34. The FIR records that co‑accused Jatashankar Singh stabbed the informant's son, but no specific allegation of a stabbing or any overt act is made against the petitioner. The petitioner asserted a clean antecedent and had been in custody since 2 September 2025. The State opposed bail. The court, after considering the nature of the accusation, the petitioner’s clean record and the period of custody, allowed the bail application, directing release on a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged with offences under IPC sections 341, 323, 324, 307, 379/34
  • Whether the absence of a specific allegation against the petitioner justifies granting bail

                                2. Petitioner seeks regular bail in connection with

Paharpur P. S. Case No. 387 of 2022 in a case registered for the

inflicted knife blow to the son of informant causing severe

                   injuries.

                                4. Learned counsel for the petitioner submits that

specific accusation of stabbing is against co-accused

Jatashankar Singh. There is no allegation of any specific overt
