Patna High Court

Ravi Ranjan KumarversusThe State of Bihar

Holding

The Court allowed the bail application, granting anticipatory bail with bond and sureties subject to statutory conditions.

Summary

Ravi Ranjan Kumar was implicated in a cyber‑crime FIR (Warsaliganj PS Case No.374 of 2025) under multiple sections of the Bharatiya Nyaya Sanhita, 2023 and the I.T. Act, based solely on the statement of a co‑accused seized during a police raid. No incriminating material was recovered from Kumar’s possession or residence, and he has no prior criminal record. He applied for anticipatory bail, arguing that the case is false and that a co‑accused, Manish Kumar, had been granted bail in a similar matter. The State opposed the bail. The Court, after considering the facts, ordered that Kumar be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The application was allowed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail despite the FIR under multiple sections of the Bharatiya Nyaya Sanhita and the I.T. Act.
  • Whether the lack of seized material and the petitioner’s clean record justify bail.
  • Whether the conditions prescribed under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 are satisfied.
