Bail was granted to the petitioner subject to a Rs. 10,000 bond and two sureties.

Summary

Laddu Alam, aged about 22, applied for bail fearing arrest in a case (Majhauliya PS Case No.507 of 2025) filed under multiple sections of the Bharatiya Nyaya Sanhita, 2023, alleging assault on a woman and her son with an iron rod and sword. The petitioner contended that the specific allegation against him was the assault of the son with an iron rod, while co‑accused had been granted anticipatory bail in a related matter. The State opposed the bail, citing the seriousness of the charges including offences under sections 190, 191(2), 191(3), 126(2), 115(2), 303(2), 74, 109(1), 324(2) and 308(4). The Court, after considering the facts, the pending cases against the petitioner, and the bail granted to co‑accused, ordered that the petitioner be released on bail upon furnishing a bail bond of Rs. 10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The application for bail was therefore allowed.

Issues considered

  • Whether bail should be granted to the petitioner in view of the charges under Sections 190, 191(2), 191(3), 126(2), 115(2), 303(2), 74, 109(1), 324(2) and 308(4) of the Bharatiya Nyaya Sanhita, 2023.
