Holding

The Court held that the petitioner is entitled to bail under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Sanni Singh, sought bail after being named in FIR No.215 of 2024 under multiple offences of the Bharatiya Nyaya Sanhita, 2023, relating to a container accident, looting, assault and theft. The prosecution alleged that the accused obstructed police, assaulted the driver and stole goods, but the petitioner's charge was described as a general, omnibus allegation without specific details. The petitioner highlighted that two co‑accused had already been granted anticipatory bail and that he had only one other criminal case pending. The State opposed the bail, arguing the seriousness of the charges. The Court, after considering the lack of specific allegation and the precedent of anticipatory bail to co‑accused, ordered that the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether the petitioner is entitled to bail despite being named in an FIR with only a general allegation.
  • Whether Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, permits the grant of bail in the present circumstances.
  • Whether the grant of anticipatory bail to co‑accused influences the petitioner's bail application.
