The Court granted regular bail to the petitioner in the Arms Act offences.
Summary
The petitioner, Md. Saddam, was arrested in connection with offences under Sections 25(1‑B)(a) and 26 of the Arms Act and has been in custody since 19 October 2025. He previously applied for regular bail, which was rejected, but the Court had earlier granted him liberty to renew the bail application after six months of detention. Relying on that liberty, he filed a fresh bail petition, contending that the prosecution lacks an independent witness, that the seizure list was not prepared in accordance with Section 105 of the BNSS, and that he has been falsely implicated due to local enmity. The State opposed the bail, but the Court, after considering the submissions and the procedural irregularities alleged, decided to grant regular bail. The petitioner was ordered to furnish a bail bond of Rs. 20,000 with two sureties of the same amount.
Issues considered
- Whether the petitioner is entitled to regular bail after six months of custody under the Arms Act.
- Whether the alleged non‑compliance with Section 105 of the BNSS and lack of an independent witness justify granting bail.
- Whether the petitioner's claim of false implication and local enmity affect the bail decision.
