Patna High Court

Shankar RayversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied.

Summary

Shankar Ray was arrested in connection with a case involving multiple offences under the Bharatiya Nyaya Sanhita, 2023, including assault, robbery and causing grievous injury. The FIR alleges that he, along with several others, assaulted the informant’s wife and nephew, damaged property, and later assaulted the informant with an iron rod causing head injury. The petitioner claimed innocence, asserting that the case stemmed from a land dispute and that he was falsely implicated. He applied for anticipatory bail, arguing that the allegations were fabricated. The court, after hearing both sides, refused anticipatory bail, directing the petitioner to surrender within four weeks and allowing the trial court to consider a bail application on surrender.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the Bharatiya Nyaya Sanhita, 2023.
  • Whether the allegations in the FIR constitute sufficient ground to deny anticipatory bail.
