Lalita MarandiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to regular bail and is ordered to be released upon furnishing the prescribed bail bond and sureties.

Summary

Lalita Marandi, a widow, was arrested in connection with a case registered under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022, alleged to involve illegal liquor. She contended that she was falsely implicated due to a village rivalry and that the seizure was conducted without an independent witness. Her counsel highlighted that she had previously been granted bail in a similar case and had been in custody since 20‑02‑2026. The State opposed the bail application. Considering the petitioner's claim of innocence, the lack of an independent witness to the seizure, and the circumstances presented, the Court decided to release her on regular bail upon furnishing a bail bond of Rs. 20,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022 despite the allegations and prior antecedent.
