Patna High Court

Sachin KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond of Rs.10,000 with two sureties and specified conditions.

Summary

Sachin Kumar was arrested on 8 April 2026 in connection with a case alleging the recovery of 1,560 litres of liquor from a pickup vehicle, charged under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Amendment Act. The petitioner argued that he has a clean antecedent, is not the owner of the vehicle, and that the seizure was effected by police officers without complying with mandatory provisions of Sections 103 and 105 of the BNSS, 2023. The State opposed bail. The Court considered the lack of evidence of the petitioner’s personal possession of the liquor, the procedural lapses, and the petitioner’s clean record, and ordered his release on bail upon furnishing a Rs.10,000 bond with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of antecedents. The bail order also empowered the prosecution to move for cancellation if conditions are breached. The petition for bail was therefore disposed in favour of the petitioner.

Issues considered

  • Whether bail should be granted to the petitioner despite the alleged seizure of liquor and charges under the Bihar Prohibition and Excise Amendment Act.
  • Whether non‑compliance with Sections 103 and 105 of the BNSS, 2023, by the investigating police affects the grant of bail.
  • Whether the petitioner’s lack of ownership of the vehicle and absence of personal possession of the liquor are material factors for bail.
