Holding
The court held that bail should be granted to the petitioner, subject to strict conditions, despite the seriousness of the alleged offence.
Summary
Raushan Kumar, an Assistant Engineer, was accused under Section 7 of the Prevention of Corruption Act, 1988 for demanding a 10% bribe (Rs 5,70,000) to release a government contract payment of Rs 57,00,000. He was caught red‑handed on 02‑03‑2026 accepting Rs 5,00,000 and a smartwatch, and has been in custody since 03‑03‑2026. The petitioner sought bail, arguing a clean antecedent and invoking the principle that bail is the rule and jail the exception, citing Supreme Court precedents. The Special Vigilance Unit opposed bail, highlighting the recovery of Rs 42,00,500 from the petitioner’s residence and the red‑handed evidence. The High Court, after considering the facts, clean antecedent, and the charge‑sheet, granted bail on a Rs 10,000 bond with two sureties, subject to conditions of cooperation, appearance, and non‑tampering with evidence. The order was pronounced by Justice Rajesh Kumar Verma.
Issues considered
- Whether bail should be granted to an accused under Section 7 of the Prevention of Corruption Act, 1988 in view of the red‑handed nature of the alleged offence.
- Whether the petitioner’s clean antecedent and the principle of bail as a rule outweigh the seriousness of the alleged corruption offence.
