The Court held that anticipatory bail is appropriate as the petitioner has a clean antecedent and no material directly linking him to the recovered liquor, and therefore granted bail.
Summary
The petitioner, Deepak Kumar, was implicated in a case involving the recovery of 857.52 litres of illicit liquor and charged under Sections 30(a) and 41 of the Bihar Prohibition & Excise Act, 2022. He applied for anticipatory bail, contending that the only basis for his accusation was a disclosure by a co‑accused and that no liquor was found in his possession. The prosecution opposed the bail, invoking Section 76(2) of the same Act and noting the petitioner’s other pending cases. The Court, relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar, observed that the petitioner had a clean antecedent and that similarly situated co‑accused had been granted bail. Consequently, the Court granted anticipatory bail under Section 438 of the CrPC and Section 482 of the Bihar Narcotic and Substances (BNSS) Act, subject to strict conditions.
Issues considered
- Whether anticipatory bail can be granted when the accusation is based solely on a co‑accused's disclosure under the Bihar Prohibition & Excise Act.
- Whether Section 76(2) of the Bihar Prohibition & Excise Act bars the grant of anticipatory bail.
- Whether the absence of any seized liquor from the petitioner’s possession justifies the grant of anticipatory bail.
