The Court granted anticipatory bail to the petitioner, subject to a bond and conditions prescribed under the B.N.S.S., 2023.
Summary
The petitioner, Dhandhan Kumar, was named in FIR No. 487 of 2025 for alleged theft, assault with an iron rod, and related offences under the Bharatiya Nyaya Sanhita, 2023. He contended that the case was false, arising from a family dispute over petrol mixing, and that a counter‑case had been filed by him. The petitioner sought anticipatory bail, arguing innocence and citing an injury report showing only simple injuries. The State opposed the bail, noting the mutual animosity and the existence of both cases. The Court, after considering the circumstances, granted anticipatory bail subject to a bond of Rs.30,000 and conditions under Section 2(1)(d) and Section 482(2) of the B.N.S.S., 2023.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under the Bharatiya Nyaya Sanhita, 2023 in view of the alleged offences and the existence of a counter‑case.
