Rohit Kumar YadavversusThe State of Bihar

Decided

BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond of Rs.10,000 and specified conditions.

Summary

Rohit Kumar Yadav was arrested on 1 March 2026 in connection with a case alleging the recovery of 378 litres of illegal Nepali liquor from a sack loaded on two motorcycles. He was charged under Sections 274, 275 and 3(5) of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition and Excise Amendment Act. The petitioner argued that he has a clean antecedent, is not the owner of the motorcycles, and was implicated only on suspicion with no direct possession of the liquor. The prosecution opposed bail, citing the seriousness of the offence. The court considered the facts, the petitioner’s lack of prior record, and the principle of bail, and ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions regarding attendance, non‑tampering with evidence, and verification of antecedents. The bail order was directed to be implemented by the Exclusive Special Judge Excise, Madhubani.

Issues considered

  • Whether bail should be granted to the accused in a case involving alleged illegal liquor possession under the Bihar Narcotic Substances Act and the Bihar Prohibition and Excise Amendment Act.
  • Whether the petitioner poses a risk of tampering with evidence or fleeing from trial.
  • Whether the petitioner’s clean antecedent and lack of ownership of the motorcycles justify bail.
