Patna High Court

Pintu Chaudhary @ Pintu ChaudhariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to stipulated conditions.

Summary

Petitioner Pintu Chaudhary sought anticipatory bail after an FIR was lodged under Section 30(a) of the Bihar Prohibition & Excise Amendment Act, 2016, alleging that 25 litres of country-made liquor were recovered from his motorcycle. He contended that he merely owned the motorcycle, which he had lent to a villager, and that no liquor was in his possession. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar, which permits anticipatory bail despite the bar in Section 76(2) when no offence is made out, the petitioner argued for bail. The court examined the facts, noted the absence of possession, and applied the precedent, concluding that anticipatory bail could be granted. Accordingly, the court ordered anticipatory bail with a Rs.10,000 bond, two sureties, and several conditions under Section 438(2) of the Cr.P.C.

Issues considered

  • Whether anticipatory bail can be granted in a case under the Bihar Prohibition & Excise Amendment Act despite the bar under Section 76(2).
  • Whether the petitioner’s alleged ownership of the motorcycle, without possession of the liquor, justifies granting anticipatory bail.

that he was carrying the liquor.

                       5. Further, learned counsel for the petitioner relied on

the judgment of the Full Bench of Hon’ble Patna High Court in

the case of Ram Vinay Yadav vs. State of Bihar reported in

2019 (2) PLJR 1089 wherein it has been held that an

Excise and Prohibition Act can be maintained, despite the bar

under Section 76(2) of the Act, if on the basis of allegation

also that nothing has been recovered from his conscious

possession, FIR is there, he shall be facing the trial, in that

background, Court is inclined to extend him the privilege of

          anticipatory bail.
