Patna High Court

Chandan KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was refused.

Summary

The petitioner, Chandan Kumar, was implicated in an NDNDPS case (Case No. 03 of 2025) arising from a FIR that reported the seizure of 16.32 kg of ganja, a digital weighing machine, and Rs. 2,71,000 from his residence. He sought anticipatory bail, arguing that he feared arrest. The court examined the seriousness of the alleged offences under Sections 20(ii)(B), 22, 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, noting the large quantity of narcotics and cash involved. Considering the gravity of the seizure and the potential for flight or tampering with evidence, the court found no sufficient ground to grant anticipatory bail. Consequently, the court refused the petitioner's request for anticipatory bail, leaving the criminal proceedings to continue.
