Patna High Court

Vikram Singh @ Vikram KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that, given the petitioner’s involvement in cyber fraud and the progress of the trial, there was no ground to grant regular bail.

Summary

Vikram Singh was charged under Sections 316(2), 318(4), 319(2), 338, 336 and 3(5) of the B.N.S. and Sections 66(C) and 66(D) of the Information Technology Act, 2000 for opening a mule account and diverting Rs. 30 lakh to his own account. He filed a second application for regular bail after the first was rejected on 8 October 2025. The prosecution alleged that the petitioner was a cyber fraudster and that the trial was underway with four of seven witnesses examined. The petitioner’s counsel argued that the trial’s progress warranted bail. The court, noting the seriousness of the cyber‑fraud offences and the stage of the trial, found no ground to revisit its earlier order and dismissed the bail application.

Issues considered

  • Whether regular bail should be granted to the accused in view of the nature of the offences under the B.N.S. and the Information Technology Act, 2000.
  • Whether the earlier order denying bail can be reviewed at this stage of the trial.

No. 03 of 2025 registered for the offence under Sections 316(2),

                   318(4), 319(2), 338, 336 and 3(5) of B.N.S. and Sections 66(C )

and 66(D) of the Information Technology Act, 2000. Earlier the

bail application of the petitioner was rejected vide order dated

08.10.2025 passed in Cr. Misc. No. 34485 of 2025.

                                3. As per the prosecution case, petitioner had opened a

mule account in the name of the informant who was his

employee and he got Rs. 30 lakhs transferred in the account of

                                     4. It has been submitted by the learned counsel for

the petitioner that the trial is progressing and four out of seven

                        witnesses have been examined.

                                     5. Considering that petitioner is a cyber fraud, this

Court finds no ground to review its earlier order.

                                     6. Accordingly, this application is dismissed again.
