Patna High Court

Md. SikandarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner, finding the procedural lapses sufficient to justify release.

Summary

The petitioner, Md. Sikandar, was charged under section 30(a) of the Bihar Prohibition and Excise Act in PS Pirbahore case No. 265 of 2026. He contended that he was falsely implicated, that the alleged seizure was fabricated, that no independent witness observed the seizure, and that the mandatory requirement of Section 105 of the BNSS for photographing or video‑recording the search was not complied with. The State opposed his bail application, noting that he already has an antecedent case of a similar nature for which he is on bail and has been in custody since 27‑03‑2026. After considering the submissions, the Court found merit in the petitioner's claims of procedural lapses and, despite the antecedent, decided to grant regular bail. The order directed the petitioner to furnish a bail bond of Rs. 20,000 with two sureties of the same amount.

Issues considered

  • Whether the petitioner is entitled to regular bail despite alleged procedural violations in the seizure and his prior antecedent case.

                                    5. In the facts and circumstances of this case and

considering the statements made in the petition as well as above

submissions, this Court is inclined to release him on bail.

Accordingly, let the petitioner named-above be released on bail
