Decided

BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to a bail bond and sureties, under Section 482 of the Bhartiya Nyaya Sanhita.

Summary

The petitioner, Suraj Ray, sought anticipatory bail fearing arrest in a case registered under multiple offences of the Bhartiya Nyaya Sanhita, including assault and related provisions. The FIR alleged that he, along with co-accused, assaulted an informant using a fasra and iron rod, causing simple injuries, but the complaint was described as general and lacking specific overt acts against him. The State opposed the bail application, arguing the seriousness of the charges. The Court considered the nature and extent of the injuries and the lack of specific incriminating details, and applied Section 482 of the Bhartiya Nyaya Sanhita to grant anticipatory bail. The petitioner was ordered to furnish a bail bond of Rs.10,000 with two sureties of equal amount, subject to conditions prescribed by the Chief Judicial Magistrate, East Champaran.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482 of the Bhartiya Nyaya Sanhita in view of the alleged offences.
  • Whether the allegations in the FIR constitute sufficient specific acts to deny bail.
