The Court granted bail to the petitioner subject to a bond of Rs 10,000 and the conditions specified in the order.
Summary
The Patna High Court considered a bail application filed by Hitesh Ram, who has been in custody since 15 October 2025 in connection with Kesariya P.S. Case No. 93 of 2023, involving offences under IPC sections 323, 341, 302 and 34. The petitioner contended that he was falsely implicated, has a clean antecedent, and that the FIR was lodged after the post‑mortem, with similar co‑accused already granted anticipatory bail. The State opposed the bail. Weighing the petitioner’s clean record, the delay in filing the complaint and the precedent of anticipatory bail to co‑accused, the Court ordered his release on bail with a bond of Rs 10,000 and two sureties, imposing conditions of cooperation, non‑tampering with evidence and verification of antecedents. The bail bond was to be accepted without delay for verification. The order reflects the Court’s exercise of discretion to balance the seriousness of the charges with the petitioner’s personal circumstances.
Issues considered
- Whether the petitioner is entitled to bail despite being charged with murder and other serious offences
- Whether the delay in filing the FIR and the petitioner’s clean antecedent justify granting bail
- Whether the grant of anticipatory bail to co‑accused persons influences the decision to grant bail
