The court held that anticipatory bail is permissible as no liquor was recovered from the petitioner’s possession, he has a clean antecedent, and the co‑accused’s statement alone does not justify denial of bail.
Summary
Diwana Kumar was implicated in a 2018 case for alleged possession of 160 litres of illicit country-made liquor under Sections 30(a) and 32(2) of the Bihar Prohibition and Excise Act. The petitioner claimed a clean antecedent and argued that the liquor was recovered from a vehicle, not from his conscious possession, and that only the co‑accused Ankit Kumar’s statement linked him to the crime. The State opposed anticipatory bail, invoking Section 76(2) of the Act which bars pre‑arrest bail. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar, the court held that anticipatory bail could be granted given the lack of direct evidence against the petitioner. The court ordered that the petitioner be released on bail upon surrender, subject to a Rs.10,000 bond, two sureties, and conditions under Section 438(2) of the CrPC, including cooperation with the trial and no tampering with evidence.
Issues considered
- Whether anticipatory bail can be granted to a person accused under Sections 30(a) and 32(2) of the Bihar Prohibition and Excise Act.
- Whether the co‑accused’s statement alone suffices to deny anticipatory bail.
- Whether Section 76(2) of the Bihar Prohibition and Excise Act bars pre‑arrest bail in such cases.
