Patna High Court

Vikash KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to strict conditions, exercising its inherent powers under Section 482(2) of the CrPC.

Summary

Vikash Kumar sought anticipatory bail after being implicated in a case (P.S. Case No. 47 of 2026) for alleged possession of 54 litres of country-made liquor recovered from the courtyard of Rajesh Kumar Kamat, under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2018. The petitioner claimed innocence, stating that no liquor was found in his possession or residence and that the recovery was from Kamat’s premises. The State opposed the bail, arguing the seriousness of the offence. The High Court, after considering the submissions, granted anticipatory bail on the condition that the petitioner surrenders within six weeks, furnishes a bail bond of Rs.10,000 with two sureties, and complies with several conduct conditions, invoking its inherent powers under Section 482(2) of the CrPC. The order also stipulated cancellation of bail for non‑cooperation, tampering with evidence, or involvement in similar offences.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the inherent powers of the High Court in view of the allegations under the Bihar Prohibition and Excise Act, 2018.
  • Whether the petitioner’s claim of innocence and lack of direct recovery of liquor from his possession warrants bail.
