Decided

BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to bail bonds and conditions under Section 482(2) of the Bharatiya Nyaya Sanhita.

Summary

Ram Chandra Kewat and Rajesh Kewat applied for anticipatory bail fearing arrest in PS Semra Case No.27 of 2026, which alleges assault with a lathi on an informant and his brother. The petitioners claim they were falsely implicated, asserting the case is a counter‑blast of an earlier case and that the injuries were minor. The State opposed the bail, contending the offences under the Bharatiya Nyaya Sanhita are serious. The Court examined the facts, the petitioners' prior criminal history, and the risk of flight or tampering. It ordered that, if the petitioners surrender within six weeks, they shall be released on anticipatory bail upon furnishing a bail bond of Rs 10,000 each with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nyaya Sanhita.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the Bharatiya Nyaya Sanhita
  • Whether the alleged offences constitute a serious non‑bailable offence warranting denial of bail
  • Whether the petitioners pose a risk of fleeing, tampering with evidence, or influencing witnesses
