The petition for regular bail was denied.
Summary
The petitioner, Neha Kumari, was arrested in connection with an NDPS case where 175 kg of ganja was seized from a vehicle she was traveling in with accused Raju Kumar. She applied for regular bail, citing her conduct and other circumstances. The High Court examined the seriousness of the offence under Sections 8(c), 20b(ii)(c) and 27(A) of the NDPS Act and the large quantity of narcotics involved. Considering the gravity of the charge and the risk to the investigation, the Court rejected the bail application. However, the Court directed the trial court to expedite the trial and conclude it within one year from receipt of the order.
Issues considered
- Whether the petitioner is entitled to regular bail under the NDPS Act given the quantity of narcotics seized
- Whether the circumstances warrant denial of bail despite the petitioner’s custody since 19-02-2025
