Patna High Court

Pawan Kumar @ Pawan SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to statutory conditions.

Summary

Pawan Kumar was implicated in a case (Fatuha PS Case No.892 of 2019) under Section 30(a) of the Bihar Prohibition and Excise Act for the alleged recovery of 65 litres of Mahua liquor from the bank of the Punpun River. The petitioner argued that no liquor was found in his conscious possession and that the accusation stemmed from hostile locals. The State opposed the bail application. The Court considered the facts, the lack of direct possession, and the statutory provisions governing bail. It ordered that the petitioner be released on bail upon furnishing a Rs.10,000 bond with two sureties, subject to conditions prescribed under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The application for bail was allowed.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act when the alleged contraband was not found in his possession.
  • Whether the conditions imposed under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, are appropriate for the grant of bail.
