The Court granted anticipatory bail to the petitioner under Section 482 of the BNSS, 2023, subject to a bond and verification conditions.
Summary
The petitioner, Dharmendra Kumar, the registered owner of a pickup van, was implicated in a case where 327 litres of foreign liquor were recovered from his vehicle under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. He filed an application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, asserting his innocence and a clean criminal record. The State opposed the bail, noting his ownership of the vehicle. The High Court, after considering the clean antecedent and lack of possession by the petitioner, granted anticipatory bail subject to a Rs.30,000 bond and conditions including verification of his criminal antecedent by the trial court. The order also stipulated that any concealment of antecedent would lead to cancellation of the bail bond.
Issues considered
- What is the appropriateness of granting anticipatory bail under Section 482 of the BNSS, 2023 to a vehicle owner alleged to be involved in a liquor seizure?
- Whether the petitioner’s clean criminal antecedent and lack of direct possession justify the grant of anticipatory bail?
