Anticipatory bail was granted to the petitioners subject to a bail bond, sureties and conditions under Section 482 of the B.N.S.S., 2023.
Summary
The petitioners—Mantu Ravidas, Ajay Ravidas, Matla Ravidas and Baby Devi—filed an anticipatory bail application fearing arrest in a case registered under Sections 191(2), 190, 115(2), 126(2), 109 and 303(2) of the Bhartiya Nyaya Sanhita for allegedly assaulting four sons of an informant. The FIR described the injuries as simple and the petitioners asserted a clean antecedent. The State opposed the bail. The Court, after considering the nature of the injuries and the petitioners' clean record, ordered that they be released on bail if they surrender within eight weeks, upon furnishing a bail bond of Rs.10,000 with two sureties of equal amount, subject to conditions under Section 482 of the B.N.S.S., 2023. The order was pronounced by Justice Prabhat Kumar Singh.
Issues considered
- What is the appropriateness of granting anticipatory bail to the petitioners under the circumstances?
- Do the allegations under Sections 191(2), 190, 115(2), 126(2), 109 and 303(2) of the Bhartiya Nyaya Sanhita warrant denial of bail?
- Can Section 482 of the B.N.S.S., 2023 be invoked to impose conditions on the bail?
