Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to the payment of the balance settlement amount and compliance with the conditions of Section 438(2) of the CrPC.

Summary

The petitioner, Ravi Kumar, feared arrest in a criminal case (Manjhi P.S. Case No. 207 of 2022) filed under Sections 406 and 420 of the Indian Penal Code. Both the petitioner and the informant submitted that the dispute had been settled, with the petitioner agreeing to pay Rs. 3,15,000 to the second opposite party, of which Rs. 1,57,500 had already been paid. A mediation report from the Patna High Court Mediation Centre supported the settlement. The petitioner sought bail, offering a bail bond of Rs.10,000 with two sureties and proposing to furnish a demand draft for the balance amount at surrender. Justice Sandeep Kumar ordered that bail be granted subject to the stipulated conditions, including the payment of the balance amount to the opposite party and compliance with Section 438(2) of the Code of Criminal Procedure.

Issues considered

  • Whether bail should be granted in a case involving alleged offences under Sections 406 and 420 IPC when the parties have settled the dispute.
  • Whether the conditions imposed under Section 438(2) of the CrPC are sufficient to justify the grant of bail.
